I recall reading an article about this awhile back, and that it said something about roadside memorials being protected in some states. So I did a search, and found the article...

The State of Georgia created a law that provides grieving families with their roadside memorial, paid for out of funds collecting from drunk-driving fines. These signs are about the same size as a stop sign, and remain standing for five years.

The State of New Mexico, which is caught up in its own native American culture, designates homemade roadside memorials as "traditional cultural properties."

Wisconsin had actually banned them until public outcry prompted the state to reverse its position in 2003.

These roadside memorials are all over Southern California, where I live. I think technically, these are illegal statewide as a form of littering, or even at the local level as illegal sign posting.

I've heard some arguments that roadside memorials are a form of free speech. False! It's only free speech if you are physicially standing there with the memorial. If you leave the memorial behind it becomes litter, or an illegal sign posting.

And these memorials seem to be popping up at an increasing rate. When someone sees someone else do it, they tend to follow suit.

Eventually, someone will slam their car or motorcycle into the back of another car parked along the side of a road, that was setting up a roadside memorial, and it will set a precedent on enforcing these things.
