Ontario Court Rejects Religious Helmet Exemption

by Steve
Thursday, March 06, 2008

Sikh turban motorcycle helmetA devout Sikh named Baljinder Badesha wears a turban as part of his religion. And so when it comes to riding his motorcycle, he can't fit his helmet on top of it.

But an Ontario court has ruled that Badesha will have to figure out a way to get that brain bucket on there.

Interestingly, the judge said that he sides with the defendant's right to religious freedom, but that the "benefit that society gains in possible reduced health costs" trumps his rights...

Ontario Court Judge James Blacklock ruled today that while the law prohibiting anyone riding a motorcycle without a helmet does violate his right to freedom of religion, it's justifiable in terms of the benefit that society gains in possible reduced health costs and the possible loss of people's loved ones.
Opinion...

That's the problem with a society that taxes its citizens so heavily. They don't want to lose your productivity.

Though, me thinks that this Badesha fellow can find a special helmet that he can wrap a turban around.
